A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a mistaken removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her decision, the judge noted that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
